ALL CLIENTS SHOULD READ AND UNDERSTAND THE FOLLOWING BEFORE BOOKING A MODEL.
Confirmation of Booking
As required by the Department of Employment regulations, Century Models booking confirmation containing the terms of the booking must be signed and returned by the client prior to the job.
Booking Fees
Rates vary depending on the experience and locality of the model. Booking fees are charged by the day or by the hour, or on some other basis, for example, a set fee for a catwalk show.
"Permitted" usage, 1-2 of the following - editorial, experimental, press advertising, brochures, leaflets, website & catalogues, to be used in the UK only for up to one year.
All fees are based on the following:
Full day = 8 hours
Half day = 4 hours
Minimum booking = 2 hours
Excluding equity contracts, models' time will be charged at the hourly rate unless a half day or full day booking has been pre-arranged in writing.
All fees quoted are for 1-2 areas within standard usage (not including packaging, posters or show cards) unless otherwise requested in writing. The standard use covers the right to use the image in the UK only for up to 1 year unless otherwise agreed in writing.
Usage Fees
Fee's are quoted separately when anything other than the "permitted" usage is required. It is the clients’ responsibility to make the agency aware of the usage prior to each booking.
Additional (usage) Fees
To be negotiated at the time of booking
Additional fees are payable for the right to use the photographs (or reproductions, or adaptations of, or drawings there from - either complete or in part, alone or in conjunction with any wording or drawings including electronic imaging) for all known or anticipated purposes other than the initial permitted use (e.g. for packs, swing tickets, record covers, show-cards, posters etc.). Unless otherwise agreed in writing.
To be agreed after the booking
It is the client's responsibility to notify the agent and negotiate additional fees (including extensions of existing agreements) for any usage, which may be required or anticipated subsequent to the time of booking.
Agency Fees
20% is charged on all hourly, daily and usage fees on bookings, except Equity contract TV Commercials. VAT and agreed expenses will be added where appropriate.
Both agency fees and model fees will be invoiced by the agency.
Exclusion Fees
A fee will be negotiated when the work is for a company/product which preludes work for competing products. It is the client’s responsibility to check whether conflicting work has been done. If a model advertises a product he/she is able to work for any competitor unless an exclusion fee is negotiated.
Overtime
Overtime is charged at the agreed hourly rate and taken to the next hour up. Overtime rates apply outside 09:00-18:00 hours & on all bookings longer than 8hrs. The rate between 18:00hrs & midnight is 150% of the normal daily rate. Overtime between midnight & 09:00 hrs is to be negotiated. Work on Sundays & Bank Holidays is 200% of the daily rate.
Travel
Travel is charged at 20% of the hourly rate and applies to travel outside a 5 mile radius of Hyde Park Corner. Travel expenses are payable to the model on the day of the booking.
Test and Experimental Photography
A photographer is not permitted to use test and experimental photographs for commercial purposes or resale unless an agreement has been made in writing with the agency.
Complaints
Any cause for complaint should be reported to the agency when it arises. Complaints cannot be considered in retrospect.
Provisional Bookings
Provisional bookings will be automatically cancelled if they are not confirmed within 24 hours of the proposed booking or if a definite booking is offered and the provisional cannot be confirmed.
Cancellation fees
If a booking is cancelled within one working day of the starting time the full fee will be charged, unless the same model is rebooked by the same client within 24hrs, in which case 50% of the fee is charged.
If a booking is cancelled outside the one day period but within two working days of the starting time, 50% of the fee will be charged.
If a booking is cancelled outside the two day period 25% of the fee will be charged.
For trips and long bookings; if the booking is cancelled within a period equal to the length of the booking then the full fee is charged.
Saturdays, Sundays and Bank Holidays are excluded from these calculations.
Weather permitting bookings
If a booking is 'weather permitting' this must be made clear at the time of booking. At the first cancellation, 50% of the fee is charged unless the client fails to cancel in time to prevent the model's attendance, when the full fee is payable. At the second cancellation the full fee is charged.
Model Release Form
The Model Release form/Booking voucher must be signed by the model and client at the end of every booking.
Meals
Clients are responsible for models' meals on bookings.
Fashion Shows
Payment of the agreed fee confers the right to make use of a model's services on the catwalk for the specified show and the right to use photographs and video of the show for reporting purposes only. Any other usage must be negotiated at the time of booking.
Videos
The normal daily rates will apply for all videos plus a buy-out to be negotiated.
Insurance
The client is responsible for the models health and safety when the model is traveling, or providing services in connection with the booking to the same extent as if the model were an employee of the client. The client will maintain adequate insurance cover to underwrite its obligations to the model.
The agent is not responsible if the model fails to attend the booking. The client is advised to insure against any loss which might result if the model does not keep a booking because of ill health or some other reason.
Jurisdiction
These terms and conditions for booking and all other matters connected with the bookings are governed by English Law and any dispute will be settled in accordance with that law by a court in England.
Copyright
The photographer is not entitled to use any of the images he/she takes for any usage beyond that agreed. The photographer to his extent agrees to restrict use of his/her copyright and, if the model agency client is not a photographer, the client is to draw these terms and conditions to the attention of the photographer and obtain his/her agreement to them before the shoot commences.
General
All fees are to be negotiated only with Century Models
It is not permitted to use the photographs for any purpose whatsoever until all fees have been paid in full.
Whilst every endeavor is made to provide a satisfactory and efficient service to clients we cannot be held responsible for a model's conduct on an assignment.
We reserve the right to negotiate within the structure of these terms and conditions.
These terms and conditions are without prejudice to any claim against the client.
Please Note - As a supplier of services, these terms and conditions take precedence over terms and conditions that may be received from the client even when those terms and conditions have a similar clause to this.
TERMS OF EMPLOYMENT CONTRACT
This page sets out the terms and conditions of the contract between you and
Century Models, an
MPICS Digital Company. ("the company") for all work entered in to between you and Century Models.
1.
The rate of pay for each assignment is detailed on each booking sheet for each respective assignment, subject to satisfactory completion of the assignment.
2.
You are to provide your services in accordance with the terms on each booking form which constitutes a contract for service between you and the Company in respect of the assignment.
3.
Failure for any reason to complete the full assignment of to work the hours specified, or any misrepresentation as to your skills and/or qualifications, may result in a reduction of fees and, in the event of a serious breach, may (at the option of the company) render the contract null and void.
4.
In no circumstances should the contract be passed on to any other person without the prior written consent of the company.
5.

6.
You are obliged by law to pay your own National Insurance and Income Tax Deductions. A Self-Employment number must be provided by you to the Company.
7.
Similarly, you should ensure that you carry your own liability insurance in respect of the provision of your services to us and our Clients. The Company will not be liable for:
(a) any loss or damage to any property, Or
(b) any losses, liabilities, claims and costs in respect of any injury to, or the death or, any person arising as a result of any act or negligence of any personnel provided by the company, Or
(c) the dishonesty of any personnel employed by the Company whilst performing their duties.
8.
Whilst on assignment, you should al all times avoid putting yourself in any situation which may give rise to a risk to your health, safety or security.
9.
Fees are paid, unless otherwise agreed, once payment has been received from the Client by the Company providing the following has been verified:
(a) Our Client has confirmed that you have attended for the full specified period and that you have provided a satisfactory service, and
(b) You have returned any uniforms, badges, surplus vouchers or promotion material issues to you in connection with the assignment.
10.
In the event of cancellation by the Company's Client, the booking will be cancelled and no fees will be payable unless the cancellation is confirmed less than 24 hours by the Client before the booking was to commence, in which case a cancellation fee will be payable at the discretion of the Company.
11.
A fine of 50% of your agreed fee shall be imposed or deducted from monies outstanding to you from the Company if:
(a) you cancel a booking, previously accepted and confirmed by yourself, within 48 hours of the commencement of booking, or
(b) Fail to turn up for an assignment without giving required notice of 48 hours.
Once you have been booked to work for any Client, it is strictly prohibited to, at any time, work directly for that client or any associated companies within a two year period from the last date of assignment with that client.
